    1. Introduction

    Lift Atout (hereinafter "we", "our" or the "Company"), an authorized Hangcha dealer in Quebec, places great importance on protecting the personal information of visitors to its website lithiumforklift.ca (the "Site") and of its clients. This policy (the "Policy") describes the personal information we collect, why we collect it, how we use, protect and disclose it, as well as the rights you have regarding such information.

    This Policy complies with Quebec's Act respecting the protection of personal information in the private sector, as amended by the Act to modernize legislative provisions as regards the protection of personal information (commonly known as "Law 25").

    By browsing our Site, contacting us, requesting a quote or using our services, you acknowledge that you have read this Policy.

    2. Person responsible for the protection of personal information

    In accordance with Law 25, we have designated a person responsible for the protection of personal information. This person ensures compliance with and implementation of this Policy. You may contact them with any question, request for access, rectification, withdrawal of consent, or to file a complaint:

    We collect only the personal information necessary to fulfill the purposes identified in this Policy.

    3.1 Information you provide directly

    • Through our contact or quote request form: your first name, last name, email address, phone number, company name, and the content of your message or request.
    • When you contact us by phone: your phone number, your name (when communicated), and the content of your request. Calls may be tracked and, in some cases, recorded for quality, training and traceability purposes (see Section 3.3).
    • When you contact us by email: your email address and the content of your message.

    3.2 Information collected automatically during your visit

    When you visit our Site, certain technical information is collected automatically through cookies, tracking pixels and similar technologies:

    • Your IP address (partially truncated when technically possible);
    • The type and version of your browser, operating system used, type of device;
    • Pages visited, date and time of your visit, duration of the visit, navigation path on the Site;
    • Referring page (referrer URL) and exit pages;
    • Cookie identifiers or advertising identifiers.

    3.3 Call tracking and recording (CallRail)

    We use the CallRail service to measure the effectiveness of our marketing campaigns and our Site (for example, to know where a call comes from). This tool may collect: your phone number, the date, time and duration of the call, the source of the call (advertising campaign or web page that led to the call) and, where applicable, the recording of the conversation.

    When a call is recorded, you are informed at the beginning of the call. You may at any time request that the recording not be made, or request the deletion of a recording concerning you by contacting our responsible person.

    4. Purposes of collection

    We collect and use your personal information only for the following purposes:

    • Respond to your inquiries and quote requests, and follow up on our exchanges;
    • Provide our sales, rental, parts and service offerings for Hangcha forklifts;
    • Manage the business relationship (billing, delivery, after-sales service, warranties);
    • Analyze and improve the performance of the Site and user experience (traffic statistics);
    • Measure the effectiveness of our advertising and marketing campaigns, including the origin of calls and quote requests;
    • Personalize the content and advertising presented to you;
    • Comply with our legal, tax and regulatory obligations;
    • Prevent fraud and ensure the security of the Site and our services.

    We will not process your personal information for purposes that are not reasonably related to those described above, unless we obtain your prior consent.

    5. Consent

    In accordance with Law 25, your consent to the collection, use and disclosure of your personal information is express, free, informed and given for specific purposes. Depending on the context, your consent may be:

    • Express — for example, when you click "Accept" in our cookie banner or when you submit a form after confirming that you have read this Policy;
    • Implicit — for obvious and necessary purposes arising directly from your request (for example, when you call or email us to obtain a quote).

    You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting our responsible person. Withdrawal of consent will not have retroactive effect.

    6. Disclosure to third parties and service providers

    We do not sell or rent your personal information. However, we may disclose it to the following recipients, only to the extent necessary for the purposes described in this Policy:

    6.1 Our service providers

    • Google LLC (Google Analytics, Google Tag Manager) — audience measurement, usage statistics and centralized tag management;
    • Meta Platforms, Inc. (Meta / Facebook Pixel) — advertising measurement and marketing retargeting on Facebook and Instagram;
    • CallRail, LLC — tracking and analysis of incoming phone calls;
    • Tinybird — real-time processing of analytical data on Site performance;
    • Cloudflare, Inc. — content delivery network (CDN), security and protection against cyberattacks.

    These providers are contractually required to protect your information and use it only for the purposes set out in their mandate.

    6.2 Other recipients

    • Government, judicial or regulatory authorities, when required by law or to assert our rights;
    • Our business partners (including Hangcha) when necessary for the performance of an order, warranty service, or delivery of a product;
    • A potential acquirer, in the event of a merger, acquisition or transfer of assets, subject to legal protections.

    7. Disclosure of information outside Quebec

    Several of our service providers (including Google, Meta, CallRail, Tinybird and Cloudflare) are located outside Quebec, primarily in the United States and other jurisdictions. Your personal information may therefore be hosted, processed or accessed from these jurisdictions.

    Before any disclosure of personal information outside Quebec, we conduct a privacy impact assessment to ensure that the information will benefit from adequate protection, comparable to that offered in Quebec. We also enter into contractual agreements with these providers to govern the protection of your information.

    8. Retention period

    We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, or for the period required by law:

    • Information from the contact form or a quote request: retained for a period of 24 months following the last exchange, or longer if a business relationship continues;
    • Information related to a sale, rental or service: retained for the duration of the contractual relationship and for the retention periods required by applicable tax and commercial laws (generally 7 years after the end of the relationship);
    • Call recordings and phone tracking data (CallRail): retained for a maximum period of 12 months, unless the law requires longer retention;
    • Information collected through cookies: retained according to the duration of each cookie (see Part 2).

    Once these periods have elapsed, the information is securely destroyed, anonymized or archived, in accordance with our internal policies.

    9. Security measures

    We implement reasonable physical, technical and organizational security measures to protect your personal information against loss, theft, unauthorized access, disclosure, copying, use or modification, including:

    • Encryption of communications (HTTPS protocol) throughout the Site;
    • Advanced protection against cyberattacks via Cloudflare;
    • Access control to personal information (limited to employees and providers who need it);
    • Authentication of access to internal tools;
    • Awareness of our staff regarding the protection of personal information;
    • Maintenance of a register of confidentiality incidents, in accordance with Law 25.

    In the event of a confidentiality incident presenting a risk of serious harm, we will notify the Commission d'accès à l'information and the persons concerned without delay, in accordance with our legal obligations.

    10. Your rights

    Law 25 grants you several rights regarding your personal information:

    • Right of access — obtain confirmation that we hold information concerning you and receive a copy of it;
    • Right of rectification — have information that is inaccurate, incomplete or ambiguous corrected;
    • Right to withdraw consent — withdraw your consent to the collection, use or disclosure, subject to exceptions provided by law;
    • Right to data portability — receive, in a structured and commonly used technological format, the computerized information you have provided to us;
    • Right to de-indexation or cessation of dissemination — request that the dissemination of information cease or that hyperlinks providing access to it be de-indexed, where the conditions provided by law are met;
    • Right to be informed of automated decisions — be informed when a decision based exclusively on automated processing is made about you;
    • Right to file a complaint — file a complaint with our responsible person or with the Commission d'accès à l'information.

    To exercise any of these rights, please contact our responsible person (see Section 2). We will respond within a maximum of 30 days, in accordance with the law. Reasonable proof of identity may be requested.

    11. Information concerning minors

    Our Site and services are intended for a business clientele and are not directed at individuals under the age of 14. If you believe that a child under 14 has provided us with personal information without the required consent, please contact our responsible person so that we can address the issue.

    12. Changes to this Policy

    We may modify this Policy from time to time to reflect changes in our practices, services or applicable legislation. The date of the last update is indicated at the beginning of the document. We invite you to consult it regularly.

    Part 2 — Cookie Policy

    1. What is a cookie?

    A cookie is a small text file placed on your device (computer, tablet, phone) by the server of the website you are visiting. Cookies allow the site to remember certain information about your browsing: language preferences, visit statistics, advertising measurements, etc.

    3. Categories of cookies we use

    3.1 Strictly necessary cookies

    Essential for the proper functioning of the Site (security, memorization of your cookie preferences, server load balancing). These cookies are notably placed by Cloudflare for security and performance purposes. They do not require your consent.

    3.2 Audience measurement and analytics cookies

    Google Tag Manager (Google LLC) — centralized management of tracking tags deployed on the Site.

    Tinybird — real-time processing and analysis of performance and usage data of the Site.

    3.3 Advertising and retargeting cookies

    Meta / Facebook Pixel (Meta Platforms, Inc.) — measurement of the effectiveness of our advertising campaigns on Facebook and Instagram, advertising targeting and retargeting.     3.4 Call tracking cookies (CallRail)

    We use CallRail to associate the phone calls we receive with the marketing campaigns or pages of the Site that generated them. This tool may place a cookie that allows a unique phone number to be displayed dynamically based on your traffic source, and to link your call to your visit to the Site.     4. Cookie retention period

    • Session cookies — deleted when the browser is closed;
    • Persistent cookies — retained for a few days up to a maximum of 13 months for audience measurement and advertising cookies.

    5. How to manage or disable cookies

    • Via your browser settings — most browsers allow you to block or delete cookies (Chrome, Firefox, Safari, Edge, etc.);
